These Terms of Service ("Terms") govern your use of the Toxi mobile application ("App") operated by Toxi ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 17 years of age and have the legal capacity to enter into these Terms. If you do not agree to these Terms, you must not use the App.

2. Description of Service

Toxi is an AI-powered conversation analysis tool that allows users to:

Upload screenshots of text conversations for automated analysis.
Receive AI-generated assessments of conversation patterns, including potential red flags, manipulation indicators, and communication dynamics.
Receive AI-generated suggested replies.

Important: Toxi provides AI-generated analysis for informational and entertainment purposes only. It is not a substitute for professional counseling, therapy, legal advice, or any other professional service. Always seek qualified professional help for relationship concerns or personal safety issues.

3. User Accounts

Your account is identified by a unique device identifier generated upon installation. You are responsible for:

Maintaining the confidentiality of your account.
All activity that occurs under your account.
Providing accurate profile information.

You may delete your account at any time through the App's profile settings. Account deletion will permanently remove your personal data and conversation history.

4. Subscriptions and Payments

Free tier: You may use the App with a limited number of free analyses.

Paid subscriptions: Premium features are available through auto-renewable subscriptions. Subscription details:

Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel subscriptions in your device's account settings (App Store or Google Play).
Any unused portion of a free trial period will be forfeited upon purchasing a subscription.

Prices are subject to change. We will notify you of any price changes before they take effect.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws.
Upload content that you do not have the right to share, including conversations of individuals who have not consented to the analysis.
Attempt to reverse engineer, decompile, or disassemble the App or its AI systems.
Use automated systems, bots, or scripts to access or interact with the App.
Circumvent, disable, or interfere with security features of the App.
Use the App to harass, stalk, threaten, or harm others.
Upload content containing explicit, violent, or illegal material.
Create multiple accounts to abuse free analysis quotas or other limitations.

6. Content and Intellectual Property

Your content: You retain ownership of the screenshots and content you upload. By uploading content, you grant us a limited, non-exclusive license to process it solely for the purpose of providing the analysis service.

Our content: The App, its design, features, AI models, analysis methodologies, and all related intellectual property are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content.

Analysis results: The AI-generated analysis results are provided to you for personal use. You may share your analysis results, but you may not represent them as professional advice.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:

Accuracy, reliability, or completeness of AI-generated analyses.
Fitness for a particular purpose.
Uninterrupted or error-free operation.
That the analysis results will meet your expectations or requirements.

AI analysis is based on pattern recognition and may not accurately reflect the intent, emotions, or character of the individuals in the conversations analyzed. Results should be interpreted with discretion.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Damages arising from reliance on AI-generated analysis results.
Loss of data, revenue, or profits.
Personal relationship outcomes influenced by the App's analysis.
Actions taken based on suggested replies or recommendations.

Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the data practices described in our Privacy Policy.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

12. Changes to Terms

We may revise these Terms at any time by posting the updated version on our website or within the App. Material changes will be communicated through the App. Your continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Tel Aviv, Israel.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
